South Korea: Yoon's Legal Team to Pursue Injunction Against Detention Order for Impeached President

Seoul, Dec 31 (NationPress) The legal representatives of South Korea's President Yoon Suk Yeol are preparing to seek an injunction to suspend a detention warrant that has been issued against the impeached leader due to his unsuccessful bid for martial law, according to one of his attorneys on Tuesday, who labeled the warrant as 'illegal'.
Earlier that day, the Seoul Western District Court granted a request from the Corruption Investigation Office for High-ranking Officials (CIO) to issue the warrant against Yoon on allegations of orchestrating the failed martial law declaration on December 3, inciting insurrection, and misusing his power, as reported by the CIO.
The court also sanctioned a search warrant for Yoon's presidential residence located in Seoul's Yongsan district as part of the ongoing investigation.
Yun Gap-geun, one of Yoon's legal advisors, stated that the arrest and search warrants requested by the CIO are “illegal and invalid” since the CIO lacks “investigative rights” concerning insurrection-related charges.
“It is both shocking and hard to accept that a warrant was issued by an agency devoid of investigative authority,” Yun informed the press. “It is evident that the current detention warrant is illegal. We express our regret regarding the court's decision.”
Yun disclosed that the defence team intends to file for an injunction to cease the warrant's enforcement and will also request the Constitutional Court to assess the constitutionality of the warrant.
The CIO sought the detention warrant after Yoon disregarded three summons to appear for questioning concerning the brief martial law declaration.
Yun defended Yoon's choice to ignore the summons, asserting that investigators failed to consult with them to arrange a time for the president's appearance.
“He is not receiving special treatment due to his position; rather, he is facing disadvantages,” the lawyer asserted.
Yun also indicated that there is no justification for Yoon to evade an investigation, expressing that he intends to confront any investigative bodies “confidently” and “by law” if they adhere to legal protocols, as reported by Yonhap news agency.
The lawyer mentioned that Yoon will clarify his position regarding the martial law declaration at a “suitable” time and is expected to attend his impeachment trial at the Constitutional Court at least once.
