Kolkata, Nov 29 (NationPress) On Saturday, a trial court judge in Kolkata reserved the decision regarding the bail request submitted by Monojit Mishra, the main suspect in the gangrape incident involving a law student from the South Kolkata Law College (New Complex) that occurred within the college grounds earlier this year.
The judge, Souvik Dey, made this decision following an extensive hearing where legal representatives for both the accused and the victim articulated their positions. The subsequent hearing is scheduled for December 2, where the judge is anticipated to deliver the ruling.
During the session, Mishra's defense team contended that the events involving the law student did not constitute rape but were a result of mutual consent. They further asserted that the victim had previously made similar allegations, which she later retracted.
In response, the victim’s legal counsel argued that the instance referenced by the defense cannot be equated with the severe crime of gangrape. They highlighted the gravity of the offense as described by the victim in her statement.
Both the prosecution and the victim's lawyers opposed the bail application of the primary accused.
There are four individuals implicated in this case. Mishra, a former student and contractual staff member of the college, is the alleged perpetrator in the incident.
Two other former students, Jaib Ahmed and Pramit Mukhopadhyay, who were expelled following the incident, have been identified as accomplices in the crime.
The fourth accused, Pinaki Banerjee, a security guard at the law college who was described by the victim as a “sole helpless” witness, received bail last month.
It is noteworthy that Mishra, Ahmed, and Mukhopadhyay were involved with the student wing of the Trinamool Congress.
