New Delhi, July 24 (NationPress) A new public interest litigation (PIL) has been submitted to the Supreme Court, advocating for the inclusion of political parties within the framework of anti-sexual harassment legislation. In December of the previous year, the apex court had dismissed a similar petition but advised the litigant to engage with the Election Commission of India (ECI), the appropriate authority to compel recognized political parties to establish internal mechanisms for addressing sexual harassment complaints.
"If the petitioner’s concerns are not satisfactorily resolved, she retains the right to seek judicial intervention as per legal provisions," the Supreme Court had ruled.
In the latest petition, the applicant indicated that a representation was submitted to the ECI in March of this year, yet no response has been forthcoming from the electoral body.
The PIL requests a formal declaration asserting that political parties must adhere to the procedures established for the protection of women in workplaces as stipulated under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, widely recognized as the ‘PoSH Act’.
It urges the apex court to broaden the interpretation of the PoSH Act to encompass political party personnel, ensuring that these parties are held accountable for fostering a secure work environment and safeguarding individuals associated with them against sexual harassment.
