Ranchi, May 28 (ANS) Former Jharkhand Chief Minister and prominent BJP leader Raghubar Das has publicly condemned the government led by Hemant Soren for its failure to enact the Panchayat (Extension to Scheduled Areas) Act (PESA). He accused the administration of denying tribal communities their constitutional right to self-governance.
During a press briefing at the state BJP headquarters in Ranchi, Das claimed that the JMM-Congress coalition is systematically diminishing tribal culture and heritage.
“While this government professes to support tribals, it has yet to implement the PESA Act even after the rules were finalized,” he stated.
Das reminded attendees that the central government introduced the PESA Act in 1996, requiring states to develop regulations in accordance with local customs and enforce self-rule in Scheduled Areas.
“Most states have embraced PESA and empowered their Gram Sabhas. In stark contrast, Jharkhand, despite having a tribal Chief Minister, has not followed suit,” he added.
He evoked the legacy of tribal freedom fighters, such as Bhagwan Birsa Munda, Sido-Kanhu, Poto Ho, Budhu Bhagat, Phoolo-Jhano, and Tilka Manjhi, emphasizing their struggle for ‘Abua Raj’ (self-rule).
“It’s ironic that a tribal Chief Minister is now obstructing this very vision,” he remarked.
Das mentioned that the draft PESA rules were published years ago, and after extensive consultations, the Jharkhand Law Department approved them on March 22, 2024.
“Both the Supreme Court and High Court have affirmed the Act under the Fifth Schedule of the Constitution,” he pointed out.
“Tribals across 112 blocks in 13 Scheduled Area districts are now demanding to know when Gram Swaraj under PESA will be actualized. Who is preventing the government from reinstating the traditional systems of Munda, Manki, and Gram Pradhan?” he queried.
Das alleged that Hemant Soren is under pressure from “supporters of foreign religions,” claiming their influence in the government is hindering implementation.
“PESA will curtail their interference in tribal self-governance, which is why they resist it,” he asserted, adding that several ministers and leaders in the ruling coalition are working against tribal interests.
He further alleged that vested interests involved in illegal mining and the trade of sand, stone, liquor, and coal are also opposed to the Act.
“PESA would empower panchayats with authority over minor minerals and sand ghats. The government has capitulated to the syndicate mafia, which is a betrayal of the Sarna tribal community,” he concluded.
Former Union Minister of State Sudarshan Bhagat was also present at the press conference.
