Did the Calcutta HC Just Grant Bail to a Close Associate of Former WB Education Minister Partha Chatterjee?
Synopsis
Key Takeaways
Kolkata, Nov 10 (NationPress) On Monday, the Calcutta High Court granted bail to Santu Gangopadhyay, a private promoter and trusted associate of West Bengal's former Education Minister Partha Chatterjee, in relation to the primary teachers recruitment corruption scandal.
Gangopadhyay was accused of soliciting money from multiple individuals under the pretense of securing teaching positions in government-run primary schools.
A single bench led by Justice Tirthankar Ghosh approved his bail, contingent upon certain conditions. Reports indicate that the bail was sanctioned against a personal bond of Rs 5 lakh.
Notably, Gangopadhyay secured bail ahead of Chatterjee's release from judicial custody.
The evidence-gathering phase in this case at the lower court is concluding on Monday, and Chatterjee's release from the Presidency Correctional Home will follow this process. He has already been granted bail concerning all charges linked to recruitment corruption.
During court proceedings, Gangopadhyay's legal representatives argued that his name does not appear in the initial or secondary charge sheets of the primary teacher recruitment corruption case. The complainant's name is mentioned in the second supplementary charge sheet. Having been in custody for over 13 months, and with several co-accused already granted bail, his lawyers questioned the rationale for his prolonged detention.
Conversely, attorneys for the Central Bureau of Investigation (CBI) contended that Gangopadhyay unlawfully received payments from 51 individuals in exchange for teaching positions, with over Rs 1 crore traced back to his bank account. The CBI described him as a 'sub agent,' alleging that, like other detained individuals in the scam such as Kuntal Ghosh and Tapas Mandal, he facilitated monetary transactions and maintained direct communication with Chatterjee. The CBI expressed concerns that his release could lead to witness tampering.
Justice Ghosh inquired whether another accused individual in the case, Ayan Sil, had been granted bail. Upon confirmation from the lawyers, the judge approved bail for Gangopadhyay, who was detained by the CBI in November of the previous year.
