New Delhi, Sep 16 (NationPress) An advocate from the Supreme Court has called upon Chief Justice of India (CJI) B.R. Gavai to take suo-motu cognisance of the alarming discoveries regarding mass burials in Karnataka's Dharmasthala. The advocate has urged that the ongoing investigation by the Special Investigation Team (SIT) be monitored by a retired judge from the apex court.
In a letter to CJI Gavai, advocate Rohit Pandey emphasized the situation as one involving extraordinary circumstances, where visible human remains remain unexhumed due to external pressures and witnesses face intimidation.
This issue surfaced when sanitation worker C.N. Chinnayya claimed on July 3 that he had been compelled to bury bodies of victims of horrific crimes over the past two decades. He provided his testimony to the police, a magistrate, and even submitted an affidavit to the Supreme Court.
In light of his allegations, the SIT has unearthed skeletal remains, skulls, and clothing, partially validating his statements.
However, Pandey's letter has raised concerns about the current hindrances faced by the SIT.
"Despite these findings, reports indicate that the SIT is under pressure to refrain from further exhumations of visible bodies," the advocate mentioned, asserting that such shocking paralysis in the presence of undeniable evidence undermines the very essence of the rule of law.
Furthermore, the letter pointed to the harassment of lawyers aiding the victims' families.
"The Karnataka Police (outside the SIT) is reportedly being used to intimidate lawyers who assist victims in their dealings with the SIT. Such actions represent an intolerable assault on the independence of the Bar and further illustrate the erosion of the rule of law in Karnataka," it stated.
Advocate Pandey has called for immediate judicial action, urging the apex court to ensure transparency in the SIT's operations, protect witnesses and victims' families, and mandate the exhumation and forensic examination of all visible remains.
"Prompt judicial intervention is essential to ensure that the truth is not concealed and the dignity of the law is preserved," he emphasized.
