Jaipur, May 5 (NationPress) Following the arrest of Jaikrishna Patel, the Bagidora MLA from the Bharat Adivasi Party (BAP), by the Anti-Corruption Bureau (ACB) for allegedly accepting a bribe of Rs 20 lakh, the future of his Assembly membership has become a hot topic in political discussions.
Reports suggest that Patel was involved in a Rs 2 crore agreement with a mining leaseholder from Todabhim to withdraw questions concerning the mining department from the Rajasthan Assembly. The bribe was reportedly to be disbursed in multiple payments. After his arrest on Sunday, speculation has intensified regarding the potential loss of his Assembly seat.
Speaking on the matter, Rajasthan Assembly Speaker Vasudev Devnani stated that the forthcoming court ruling will dictate the next steps, emphasizing that the court will ascertain the MLA's guilt and the corresponding punishment. “Only after the court’s verdict will we proceed with actions aligned with legislative protocols,” he remarked.
“In a democracy, the electorate also plays a pivotal role, as many have successfully won elections even while incarcerated,” he added, emphasizing the impossibility of premature disqualification without a legal verdict.
Rajya Sabha MP Ghanshyam Tiwari highlighted that if an MLA poses a question in the Assembly and later retracts it for monetary gain, it breaches legislative integrity. “The Privilege Committee can investigate such situations, and the Speaker has the power to revoke membership based on their conclusions,” Tiwari noted.
He referred to previous cases in Parliament where members faced disqualification for similar infractions. Under Section 8(3) of the Representation of the People Act, 1951, if an MLA or MP is convicted and sentenced to two years or longer in prison, their membership is automatically annulled. Moreover, they become ineligible to contest elections for the subsequent six years. Offenses such as communal incitement, corruption, and sexual assault are included under this clause.
Jaikrishna Patel represents the Bagidora Assembly constituency located in Rajasthan’s Banswara district. He secured the seat during a by-election on June 4, 2024, defeating BJP’s Subhash Tambolia by a significant margin of 51,434 votes.
