A panel consisting of Justices PS Narasimha and Alok Aradhe rejected the special leave petition (SLP) submitted by the Union of India, stating their reluctance to interfere with the challenged judgment and order under Article 136 of the Constitution of India.

This SLP originated from the Delhi High Court’s judgment dated August 28, 2025, which confirmed the Central Administrative Tribunal (CAT)'s directive for the Union government to unveil the sealed cover containing Wankhede's promotion details and to promote him to the position of Additional Commissioner effective from January 2021, contingent on a recommendation from the Union Public Service Commission (UPSC). Furthermore, on October 17, 2025, the Delhi High Court imposed a cost of Rs 20,000 on the Centre for dismissing its review petition.
The Justices Navin Chawla and Madhu Jain criticized the Union government's conduct, emphasizing the necessity for the truthful disclosure of all relevant facts prior to submitting the review petition.
The Delhi High Court pointed out that the Centre had not disclosed an order from CAT in August 2025 that had stayed the departmental proceedings against Wankhede, despite this order being issued before the review petition was filed.
In December 2024, the CAT had instructed the government to release the sealed cover and determined that if the UPSC recommended Wankhede’s name, he should receive a promotion to the role of Additional Commissioner from January 2021.
