New Delhi, March 21 (NationPress) Following the discovery of a significant amount of cash at the home of Delhi High Court Justice Yashwant Varma, retired Justice S.N. Dhingra asserted on Friday that there exists deep-seated corruption in the judiciary.
In an interview with IANS, he remarked, "This is a stark instance of corruption within the judiciary. The cash was uncovered unexpectedly—there could be numerous other similar situations."
He urged for an immediate FIR against Justice Varma, stating, "The Supreme Court should have permitted the filing of an FIR and allowed the usual legal proceedings to take their course."
"A judge is not above the law. If a judge commits murder, will the Supreme Court prohibit an FIR from being filed? Judges do not have immunity in such instances," he emphasized.
The former Delhi High Court judge also criticized Justice Varma’s choice to go on leave instead of resigning. "If he refuses to resign, then impeachment is the only remaining option," he told IANS.
After the cash was discovered, the Supreme Court Collegium reassigned Justice Varma back to the Allahabad High Court, where he previously served. However, the Allahabad High Court Bar Association has vehemently opposed this transfer, voicing concerns over the decision.
In a letter to the Chief Justice of India (CJI) and other judges, the association denounced the action, arguing that reappointing a judge under investigation tarnishes the dignity of the High Court.
"If Justice Yashwant Varma is suspected of possessing such a substantial amount of cash, an inquiry should be conducted instead of merely transferring him to another High Court," the letter expressed.
The association expressed astonishment at the Collegium's decision and called for a comprehensive investigation into the issue instead of a simple transfer.
Meanwhile, the Supreme Court initiated an internal investigation against Justice Yashwant Varma in accordance with the established in-house procedure.
According to the in-house procedure, the CJI is authorized to receive complaints regarding the conduct of judges of the Supreme Court and the Chief Justices of High Courts.
Media reports indicate that a large sum of cash was discovered when firefighters responded to an incident at the judge's residence, while Justice Varma was away from home.
