New Delhi, July 3 (NationPress) Managing Director and CEO of HDFC Bank, Sashidhar Jagdishan, has filed a petition with the Supreme Court seeking to dismiss an FIR lodged against him by the Lilavati Kirtilal Mehta Medical Trust, which operates the Lilavati Hospital in Mumbai.
A panel of Justices M.M. Sundresh and K Vinod Chandran agreed to prioritize the hearing on Friday after senior attorney Mukul Rohatgi, representing Jagdishan, indicated that three judges from the Bombay High Court had recused themselves from adjudicating his request to dismiss the criminal complaint.
The accusations against Jagdishan claim that a former Trust member transferred Rs 2.05 crore to him with the intent of intimidating the father of a current Trust member.
This purported transaction was allegedly noted in a handwritten diary, which was later uncovered by current members.
The Trust further alleged that the bank attempted to offer Rs 1.5 crore under the guise of Corporate Social Responsibility (CSR) to hospital personnel, asserting this was an effort to obstruct justice and tamper with the investigation.
The conflict arose when HDFC Bank raised concerns about financial mismanagement associated with the Trust. According to the bank, trustee Prashant Mehta and his family owe considerable sums to HDFC Bank, which have not been repaid.
They have resorted to personal attacks against Jagdishan as a form of intimidation against the bank.
In a statement, HDFC Bank declared, “Recovery and enforcement actions have been undertaken by the Bank for over two decades, and at every juncture, Prashant Mehta and his family have initiated numerous vexatious legal battles. The Bank is confident that our judicial system will identify the fraudulent motives and malicious goals of the Trustee and officials of the Lilavati Trust to tarnish the reputation of the Bank and its MD and CEO.”
In response to this situation, the Trust has initiated a Rs 1,000 crore defamation lawsuit against Jagdishan, accusing him of making false and damaging remarks about the organization and its permanent trustee, Prashant Mehta.
The Trust asserts that the defamation action was taken due to a series of “malicious, false, and defamatory” statements made by Jagdishan, which they claim are part of a broader effort to undermine the reputation and operations of the charitable organization.
