Karnataka High Court Upholds FIR in Airport Harassment Case, Criticizes Accused's Actions
Synopsis
Key Takeaways
Bengaluru, April 6 (NationPress) The Karnataka High Court has rejected a petition aimed at quashing the FIR against an airport employee regarding the alleged sexual harassment of a South Korean woman at Kempegowda International Airport.
The court conveyed its strong disapproval of both the incident and the actions of the accused.
A bench led by Justice M. Nagaprasanna questioned the rationale behind sparing the accused from prosecution.
The court noted that the victim, a foreign national, had clearly detailed her experience and expressed concern about why the accused had taken her to a men's restroom.
The bench also highlighted that the airport staffer, who is employed by a private firm, allegedly guided the South Korean woman to a washroom, compelling her to stand in a 'T' position and touching her inappropriately.
The court challenged the accused's behavior, questioning what kind of officer he was, and criticized his reasoning for directing the victim to a men's restroom.
An FIR was filed against the accused at the BIAL police station.
According to the woman’s account, the incident transpired on January 19 while she was at the airport preparing to board a flight to South Korea.
After passing through immigration, she was approached by the accused, who requested her boarding pass, alleging an issue with her check-in baggage that had triggered an alert.
The accused, who works for a company managing ground and cargo operations at the airport, claimed that returning to the main screening area would delay her and could result in her missing the flight.
He then insisted on performing a separate check and led her towards a men's washroom, where he allegedly touched her inappropriately despite her objections.
Upon her resistance, he reportedly hugged her, said “thank you,” and left the scene.
The woman promptly notified airport security, who detained the accused and handed him over to the police.
