Mumbai, Aug 7 (NationPress) Following his allegations of "vote chori," Maharashtra's Chief Electoral Officer, S Chocklingam, has requested that Opposition Leader Rahul Gandhi provide details regarding the alleged irregularities in the voter list under oath.
The CEO has cautioned that presenting false evidence could lead to penalties under Section 227 of the BNS. Additionally, he noted that submitting false evidence related to electoral rolls is punishable under Section 31 of the RP Act, 1950.
In a correspondence addressed to Rahul Gandhi, the Chief Electoral Officer stated, "As you know, the Electoral Rolls are compiled transparently in accordance with the Representation of the People Act, 1950, the Registration of Rules, 1960, and directives issued by the Election Commission of India periodically."
According to the CEO, his office provided draft Electoral Rolls for the second SSR 2024 to the Congress party in August 2024, followed by the final Electoral Rolls in September 2024.
After the final publication, no initial appeals were lodged by the Congress with the relevant district magistrates, nor were any second-level appeals submitted to the Maharashtra CEO.
Moreover, the CEO emphasized that regarding election conduct, election results can only be contested through an election petition in the High Court.
"During a press briefing today, it was noted that you raised concerns about the inclusion of ineligible voters and the exclusion of eligible ones from the Electoral Rolls. You are kindly asked to sign and return the attached declaration/oath as per Rule 20 (3)(2) of the Registration of Electors Rules, 1960, along with the names of such elector(s) so that necessary actions can be initiated," the CEO mentioned in his letter.
Earlier in June, the CEO had clarified Rahul Gandhi's allegations of manipulation and rigging in last year's state assembly elections, stating that the gross increase in electors from Assembly Elections 2019 to Lok Sabha Elections 2024 was 1.39 crore, with an addition of 48.82 lakh from Lok Sabha 2024 to Assembly 2024.
"There was a net increase of 32.25 lakh electors from Assembly Elections 2019 to Lok Sabha Elections 2024, accounting for 1.39 crore additions and 1.07 crore deletions. The total increase between Lok Sabha Elections 2024 and Assembly Elections 2024 was 48.82 lakh, with 8 lakh deletions. Thus, the net addition of Electors after Lok Sabha Elections 2024 was 40.81 lakh, with over 26 lakh of these being young voters aged 18 to 29 years," stated the CEO.
Regarding alarming assertions made by Rahul Gandhi about voter additions or deletions in Electoral Rolls, the CEO clarified, "Indian electoral regulations do not allow for any centralized addition or deletion of electors. In accordance with the Representation of People Act, 1950, and Registration of Electors Rules 1960, electoral rolls were prepared polling station-wise by 288 Electoral Registration Officers (EROs), with field verification conducted by nearly one lakh Booth Level Officers (BLOs), and active communication with political parties including the INC, providing numerous opportunities for objections and appeals. Any modifications in the electoral rolls occur through individual statutory forms submitted by eligible individuals."
