Pathanamthitta (Kerala), Jan 12 (NationPress) The anticipation surrounding the court's ruling on the bail application of Palakkad MLA Rahul Mamkootathil remains palpable, as he is currently detained in relation to several sexual assault allegations.

Mamkootathil was taken into custody on Sunday following a covert police operation and is presently under a 14-day judicial remand.

At the time of his arrest, he was already out on bail concerning two other similar cases.

As the Thiruvalla Judicial First Class Magistrate Court deliberates on his bail application on Monday, the ramifications of the leaked chats, allegations of abortion, and purported threats are likely to heavily influence the decision on whether he will remain in custody or be granted bail.

The release of incriminating WhatsApp conversations, claims of egregious financial exploitation, forced abortion, and explicit threats purportedly made to a complainant have severely undermined the defense's assertion that the relationship was consensual.

In his bail request, Mamkootathil insists that the allegations against him are fabricated and that the relationship was consensual.

He also contends that the complainant failed to disclose her marital status, claiming he ended the relationship upon learning of it.

The defense further argues that the complainant, being an adult, voluntarily arranged her accommodations and was fully aware of the implications of her decisions.

However, investigators argue that the digital evidence collected so far directly contradicts these claims.

WhatsApp messages that have emerged indicate not only sexual exploitation but also ongoing financial abuse.

The complainant has alleged, with corroborative evidence, that Mamkootathil pressured her into purchasing a luxury 3BHK apartment in Palakkad and coerced her into financing a trip to the UK, along with expensive clothing and shoes.

These communications could lead the court to conclude that the relationship was allegedly manipulated for financial gain rather than representing a consensual romantic involvement.

The most significant barrier to bail arises from the allegations concerning abortion.

The complainant claims that Mamkootathil initially expressed a desire to have a child to preserve the relationship, but later rejected the pregnancy, shamed her, and coerced her into undergoing an abortion.

Despite her willingness to undergo a DNA test to confirm paternity, Mamkootathil reportedly avoided it.

Legal experts emphasize that even within a consensual relationship, forcing a woman to terminate a pregnancy is a serious criminal act and infringes upon her physical and mental autonomy.

Compounding the prosecution's case, a threatening message allegedly sent by Mamkootathil to the complainant in a separate rape case has come to light.

In the message, Mamkootathil is said to have warned that he would retaliate “in kind” against opponents and their families, asserting he has nothing left to lose, and challenged the complainant to file lawsuits or hold a press conference.

He is also accused of threatening to visit her residence with others, a charge that may bolster the prosecution's argument that he could intimidate witnesses if released.
