New Delhi, Nov 24 (NationPress) The Supreme Court has postponed the hearing regarding a plea from Gitanjali J. Angmo, the spouse of detained Ladakh-based climate activist Sonam Wangchuk, until December 8. This plea challenges Wangchuk's detention under the National Security Act (NSA). A panel of Justices Aravind Kumar and N.V. Anjaria reviewed Angmo's habeas corpus petition, which describes Wangchuk's imprisonment as “illegal” and an “arbitrary violation of his fundamental rights.”
During the proceedings, Solicitor General Tushar Mehta, representing the Union government and the Union Territory of Ladakh, requested more time to respond to the petitioner's recent rejoinder. The Justice Kumar-led Bench agreed to this request, rescheduling the matter for December 8.
Previously, the Supreme Court had allowed Angmo to revise her petition and instructed the Centre, the UT administration, and prison authorities to provide additional responses. “The petitioner is permitted to revise the petition and submit an updated copy within a week. The amended counter should be filed within ten days thereafter. Any rejoinder is to be submitted within a week afterwards. The matter is scheduled for November 24,” as per the court order on October 29.
In her revised petition, Angmo alleged that the detention order was issued without thorough consideration and that essential procedural protections under the NSA were disregarded. She also claimed that officials acted hastily and failed to provide adequate grounds for the detention in a timely manner, denying Wangchuk the chance for an effective representation.
The Ladakh administration, in a prior affidavit, maintained that Wangchuk's detention was justified due to his alleged involvement in inciting unrest in Leh. Additionally, they stated that the grounds for detention were communicated within the legally required timeframe, and the detention advisory board subsequently supported the decision.
Wangchuk, a well-known environmentalist and education reform advocate, was apprehended in September and later transferred to Jodhpur Central Jail in Rajasthan.
