New Delhi, Aug 8 (NationPress) The Supreme Court has rejected the petition of Telangana Congress MLA Aadi Srinivas, which contested the Telangana High Court's ruling that deemed BRS leader and former MLA Ramesh Chennamaneni as a German citizen, leading to his disqualification from contesting and holding public office.
Srinivas, who finished second in four elections won by Ramesh since 2009, was not declared the MLA from Vemulawada by the High Court.
Senior advocate Gaurav Agarwal, representing Srinivas, argued that despite the High Court’s finding that Ramesh engaged in fraud, he continues to receive legislative benefits, including a pension.
The Supreme Court bench, comprising Justices M.M. Sundresh and N.K. Singh, opted not to intervene in the High Court’s decision.
The court stated that it cannot revive the case since Ramesh's election term has already concluded.
Srinivas had initially approached the High Court in 2019, claiming that Ramesh concealed his status as a German citizen during the election.
In November 2019, the Ministry of Home Affairs revoked Ramesh’s Indian citizenship, stating that he had previously held German citizenship and failed to meet the necessary criteria when acquiring Indian citizenship in 2009.
The High Court ruled on November 6, 2024, that Ramesh is indeed a German citizen and imposed a fine of Rs 30 lakh for misleading the court for 15 years.
Ramesh served as MLA from Vemulawada for four consecutive terms (2009, 2010, 2014, and 2018), with Srinivas as the runner-up in all these elections.
Srinivas requested to be officially recognized as the elected representative for those terms and sought the removal of Ramesh’s name from the official records of the Election Commission and the Assemblies of Andhra Pradesh/Telangana.
While the High Court ruled Ramesh a German citizen, disqualified him from public office, and fined him, it did not grant any orders to recognize Srinivas as the MLA for the four terms.
In April, Ramesh complied with the court order, paying Rs 25 lakh to Srinivas and Rs 5 lakh to the Legal Services Authority.
The question of Ramesh’s Indian citizenship has been contentious since 2009 when he was first elected as an MLA on a Telugu Desam Party (TDP) ticket.
He retained the Vemulawada seat in the 2010 by-election as a candidate for the TRS (now BRS) and won again from the same constituency in 2014 and 2019 as a BRS nominee.
In the latest 2023 elections, BRS did not nominate Ramesh and instead fielded Lakshmi Narasimha Rao, who ultimately lost to Congress's Srinivas.
