Supreme Court to Address PIL for Inclusion of Political Parties Under Anti-Sexual Harassment Law Tomorrow

New Delhi, Dec 8 (NationPress) The Supreme Court is scheduled to consider a public interest litigation (PIL) on Monday that calls for the inclusion of political parties under the anti-sexual harassment legislation.
The petition identifies the Congress, Bharatiya Janata Party, Communist Party of India-Marxist, Communist Party of India, Trinamool Congress, Nationalist Congress Party, National People’s Party, Bahujan Samaj Party, and Aam Aadmi Party as parties involved.
According to the causelist on the apex court's website, a bench comprising Justices Surya Kant and Manmohan will be hearing this matter on December 9.
The PIL demands a declaration that political parties must adhere to the procedures for protecting women in the workplace as outlined in the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
Additionally, it seeks a directive to establish a grievance redressal mechanism for addressing sexual harassment, in line with the Supreme Court's directives from the Vishaka vs State of Rajasthan case.
"This petition aims to guarantee that political parties comply with the POSH Act and ensure a secure working environment for women, free from sexual harassment," states the plea filed under Article 32 of the Constitution.
The petitioner, Yogamaya M.G., is a practicing advocate at the Supreme Court and is dedicated to women's rights and empowerment through her professional endeavors.
Given the vast membership of political parties, the petition highlights the significant role politics plays in Indian society, noting that the existence of Internal Complaints Committees (ICCs) to handle sexual harassment cases is inconsistent among these parties. The PIL argues that the absence of standardized ICCs may result in inadequate reporting and handling of sexual harassment incidents, varied levels of victim protection, and a culture that may tolerate or overlook sexual harassment. The petition's goal is to ensure that Indian political parties prioritize creating a safe and inclusive environment for women to engage in politics.
