New Delhi, Nov 17 (NationPress) The government has issued a warning to manufacturers, importers, and resellers regarding the compulsory registration of International Mobile Equipment Identity (IMEI) numbers and the repercussions of IMEI tampering.
The Department of Telecommunications (DoT) urged all manufacturers, brand owners, importers, and sellers to adhere strictly to the established legal framework.
The Telecommunications Act, 2023 enforces severe penalties for tampering with telecommunication identifiers, including IMEI numbers.
“Section 42(3)(c) explicitly forbids tampering with telecommunication identifiers. Section 42(3)(f) indicates that knowingly possessing any radio equipment, such as mobile handsets, modems, modules, or SIM Boxes, that utilizes unauthorized or tampered telecommunication identifiers, constitutes an offense,” stated the DoT.
Penalties for non-compliance can lead to imprisonment for up to three years, fines reaching Rs 50 lakh, or both.
“These offenses are classified as cognizable and non-bailable under Section 42(7) of the Act. Furthermore, Section 42(6) stipulates identical penalties for those who abet or facilitate such offenses,” it added.
According to the Telecom Cyber Security Rules, 2024, manufacturers must register the IMEI number for every device, including mobile handsets, modules, modems, and SIM Boxes manufactured in India, with the government before their first sale, testing, research and development, or any other purpose on the Device Setu (Indian Counterfeited Device Restriction (ICDR)) portal.
Importers are also required to register IMEI numbers with the Central Government before bringing any equipment, like mobile handsets, modules, modems, or SIM Boxes bearing IMEI into India for sale, testing, research and development, or any other purpose on Device Setu.

To safeguard telecom networks and combat counterfeit devices, the Government of India has mandated strict regulations concerning IMEI registration and strictly prohibits tampering, as outlined in the Telecommunications Act, 2023, and the Telecom Cyber Security Rules, 2024.
