Calcutta High Court Denies Bail to Sheikh Shahjahan in ED Assault Case
Synopsis
Key Takeaways
Kolkata, March 19 (NationPress) The Calcutta High Court, presided by a single-judge bench, denied the bail application of Sheikh Shahjahan, a suspended leader of the Trinamool Congress from Sandeshkhali in North 24 Parganas district, who is the main suspect in the January 2024 assault case involving Enforcement Department (ED) officials.
During a raid at his residence linked to a significant Public Distribution System (PDS) scandal, Shahjahan's supporters violently attacked the ED officials and the accompanying Central Armed Police Forces (CAPF) personnel.
Moreover, Shahjahan faces additional allegations concerning illegal land acquisition in Sandeshkhali, unlawful conversion of agricultural land into fish farms using saline water, and, crucially, sexual assault against local women.
Initially apprehended by the West Bengal Police, he was subsequently transferred to the Central Bureau of Investigation (CBI) for further inquiry into the case.
On Thursday, following Shahjahan's petition for bail before Justice Suvra Ghosh’s bench, the CBI’s legal representative contested the request, asserting that his release would likely lead to witness tampering and evidence manipulation.
The CBI also pointed out that he had previously attempted to intimidate and even harm the son of a critical witness using his underworld connections, who remain at large.
Justice Ghosh concurred with the prosecution's stance and dismissed Shahjahan's bail request. However, the court noted that he retains the option to file a new bail application in the future, contingent on the investigation's advancement and any emerging facts.
Initially, the Trinamool Congress leadership, including Chief Minister Mamata Banerjee, sought to support Shahjahan. Yet, following sustained protests by the women of Sandeshkhali throughout a significant portion of 2024, the party ultimately decided to suspend him.
Since that time, Shahjahan has repeatedly sought bail from various courts, all of which have denied his requests.
