The ED's plea was presented to the bench led by acting Chief Justice Sujoy Paul after a prior session with Justice Suvra Ghosh was postponed due to an overcrowded courtroom.
Following Justice Ghosh's departure from the courtroom, the next hearing was set for January 14. The division bench declined the ED's request for an expedited session, affirming that the matter would be addressed on the date established by Justice Ghosh.

Initially, the ED made a verbal request to the division bench, which instructed the agency's lawyer to submit a written appeal. After the counsel did so, the division bench chose not to accept the plea, stating that a judicial order had already been issued and the hearing would proceed on January 14 as determined by Justice Ghosh.
The ED's original petition accused West Bengal Chief Minister Mamata Banerjee of abusing her constitutional authority by allegedly obstructing the official duties of central agency personnel during the raids conducted on Thursday.
Furthermore, the ED has called for an investigation by the Central Bureau of Investigation (CBI) into the Chief Minister's involvement, making her a party in the case. They also requested an inquiry into the actions of senior police officials who accompanied the Chief Minister, as she allegedly interfered during the ED's operations, reportedly departing after gathering several documents.
There were also two counter-petitions filed, one by Pratik Jain and another by the Trinamool Congress. The Trinamool's counter-petition claimed that as I-PAC serves as the party's voter-strategy consultant, the ED's raid aimed to seize crucial documents pertaining to their electoral strategy for the 2026 Assembly elections, potentially sharing them with the Bharatiya Janata Party (BJP).
