Kolkata, Feb 6 (NationPress) Following two unsuccessful attempts to extend the timeline for the charge-framing procedure related to the multi-crore financial misconduct case at R.G. Kar Medical College and Hospital, former principal Sandip Ghosh along with other defendants has approached a division bench of the Calcutta High Court.
The division bench, which includes Justice Joymalya Bagchi and Justice Subhendu Samanta, has acknowledged their petition and has arranged a hearing for Thursday afternoon.
After facing repeated denials from a single-judge bench, the accused have resorted to seeking assistance from the division bench.
This case encompasses allegations of extensive financial mismanagement within the state-affiliated medical institution.
It is significant to note that the charge-framing process is also poised to commence at a special court in Kolkata later today, hinging on the ruling of the division bench.
The special court is set to address exemption requests submitted by the five defendants, including Ghosh.
On Wednesday, the single-judge bench led by Justice Tirthankar Ghosh turned down, for the second time, a request from the defendants for additional time for charge framing. This follows a ruling on January 31 where Justice Tirthankar Ghosh rejected a similar request, instructing the CBI to initiate charge framing by February 6.
On Wednesday, the defendants filed a review petition before the same bench, which was also declined. Justice Ghosh questioned its legitimacy, asserting that his prior rejection was based on thorough evaluation.
The CBI's charge sheet identifies five individuals -- Sandip Ghosh, his assistant-cum-bodyguard Afsar Ali, private contractors Biplab Sinha and Suman Hazra, and junior doctor Ashish Pandey. All five are currently in judicial custody. The accusations against them pertain to substantial financial irregularities at the medical college, and the resolution of this case is anticipated to have extensive ramifications.
