New Delhi, March 24 (NationPress) The Delhi High Court on Tuesday rejected a petition from Lalu Prasad Yadav, the chief of the Rashtriya Janata Dal (RJD), aimed at dismissing the corruption case initiated by the Central Bureau of Investigation (CBI) concerning the purported land-for-jobs scam.
A single-judge Bench presided over by Justice Ravinder Dudeja declined to interfere with the FIR, charge sheets, and the trial court’s cognisance orders, noting that the petition lacked merit.
Lalu Prasad Yadav argued that the CBI did not secure the necessary sanction for prosecution under Section 17A of the Prevention of Corruption Act prior to commencing the investigation against him.
He claimed that without such prior approval, the registration of the FIR and all subsequent actions, including the investigation and charge sheets, were unlawful and void from the outset.
This case is significant as the Delhi High Court previously refused to halt the trial proceedings, a decision later upheld by the Supreme Court.
The apex court rejected Lalu Prasad Yadav’s special leave petition (SLP) requesting a stay on the trial, indicating that the Delhi High Court should address the quashing petition. The Supreme Court also remarked that the trial court's proceedings, including the charge framing, would remain contingent on the outcome of the quashing petition.
The allegations involve claims that appointments in the Indian Railways were made in return for the transfer of land parcels to family members and associates of the former Railway Minister.
The CBI initiated the case in May 2022 against Lalu Prasad Yadav and several others, including his wife, former Bihar Chief Minister Rabri Devi, along with other family members and unspecified public officials.
Charge sheets were subsequently filed against multiple defendants under the Prevention of Corruption Act and the Indian Penal Code.
Additionally, the Delhi High Court had earlier served notice to the CBI regarding a separate plea by Lalu Prasad Yadav challenging a trial court order that mandated the framing of charges against him in the same case.
Earlier this year, the trial court noted that a prima facie case of corruption, cheating, and criminal conspiracy existed against Lalu Prasad Yadav and other accused parties.
