In a significant move, the Enforcement Directorate (ED) from the Gurugram Zonal Office has provisionally attached a commercial plot spanning 1.35 acres with an estimated worth of Rs 108 crore. This action falls under the Prevention of Money Laundering Act (PMLA), 2002, as part of an investigation concerning builder-investor relations with M/s Vatika Limited, the agency announced on Friday.
The ED's investigation commenced following multiple FIRs lodged in 2021 by the Economic Offences Wing in Delhi. These FIRs were filed under sections 120B and 420 of the IPC, 1860, against M/s. Vatika Limited and its promoters, including Anil Bhalla and Gautam Bhalla, pertaining to serious allegations of “criminal conspiracy, cheating, and dishonestly inducing innocent investors and buyers.”
The inquiry revealed that the company was enticing investors to make payments for future projects, promising high returns, such as assured returns until project completion and lease-rent returns thereafter. However, midway through, the company halted these payments and failed to deliver the promised units, thus committing offences related to criminal conspiracy and cheating, as stated in the ED's press release.
Furthermore, the investigation uncovered that the company neglected essential procedures, including the failure to renew licenses from the DTCP and lapses regarding the timely completion of the projects.
Current findings indicate that 659 investors collectively invested around Rs 248 crore across four different projects: Vatika Inxt City Centre Towers D, E & F in Gurugram, Vatika Mindscapes Tower-C in Faridabad, Vatika Towers Tower-C in Gurugram, and Vatika High Street (part of V’Lante) in Gurugram.
Despite the passage of years, these projects remain either unfinished or postponed, and no conveyance deed has been executed by the company, according to the ED's statement.
Previously, the ED had attached immovable properties valued at Rs 68.59 crore, which were subsequently confirmed by the Ld. Adjudicating Authority. Overall, the provisional attachment in this case has reached approximately Rs 176 crore.
Moreover, the ED has filed a Prosecution Complaint (PC) against M/s. Vatika Limited, its promoters, and other companies in the Vatika Group under the PMLA provisions before the Special PMLA Court in Gurugram on May 21.
