New Delhi, Nov 27 (NationPress) The Patiala House Court has granted permission for incarcerated Baramulla MP Engineer Abdul Rashid Sheikh to participate in the forthcoming Winter Session of the Lok Sabha while still in custody.
This ruling was made by Additional Sessions Judge Prashant Sharma, who stated that Engineer Rashid, currently held at Tihar Jail in a case related to terror funding, can be escorted to Parliament by police throughout the session, under previously established conditions.
The court also mentioned that the matter of who will cover the travel costs during Rashid's custody parole will depend on the outcome of his ongoing appeal in the Delhi High Court.
Earlier in the month, the Delhi High Court issued a split decision regarding Rashid's request to modify a condition mandating him to pay approximately Rs 4 lakh for travel and police deployment during his visits to Parliament.
After Justice Vivek Chaudhary denied the plea and Justice Anup Jairam Bhambhani approved it, the case was referred to Chief Justice D.K. Upadhyaya for administrative guidance. Rashid's lawyer argued before the Delhi High Court that enforcing daily custodial travel costs, including police salaries, restricts an elected MP from fulfilling his duties to his constituency.
He stated that while Engineer Rashid is willing to cover reasonable expenses, the inclusion of police salaries exceeds the limits of the Delhi Prison Rules.
Conversely, the Delhi Police defended their calculations, asserting that the total encompasses deployment, logistics, and security measures necessary for escorting an undertrial MP to Parliament.
In September, the Patiala House Court similarly allowed Rashid to vote in the Vice-Presidential election.
Engineer Rashid, leader of the Awami Ittehad Party (AIP), contested the 2024 Lok Sabha elections from Tihar Jail and achieved a significant victory over Omar Abdullah, the Vice-President of the National Conference and former Chief Minister of Jammu and Kashmir, by over two lakh votes.
