A division bench comprising Justices A. K. Jayasankaran Nambiar and Jobin Sebastian approved a 17-day delay in the appeal's filing and has issued notices to all implicated parties, instructing them to submit their responses.
This appeal challenges the December 2025 ruling of the Ernakulam Principal District and Sessions Court, which acquitted Dileep while convicting six others linked to the shocking abduction and sexual assault of a Malayalam actress in February 2017.
The prosecution alleges that the actress was kidnapped by a group of men in a moving vehicle while en route to a film shoot. She reportedly faced sexual assault, and the incident was recorded by the assailants.
The vehicle's driver, Martin Antony, was apprehended the next day, and Sunil N.S., known as “Pulsar Suni,” was later arrested as the primary suspect.
In the ensuing weeks, various other individuals were detained in connection with the case.
The state has contended in the High Court that the trial court inadequately assessed evidence indicating a broader criminal conspiracy and has requested the conviction of Dileep along with three others who were previously acquitted: Charly Thomas, Sanilkumar (alias Mesthiri Sanil), and Sarath G. Nair.
The prosecution is also advocating for an increase in the sentences given to the six convicts—Pulsar Suni, Antony, B. Manikandan, V.P. Vijeesh, H. Saleem, and C. Pradeep—arguing that their current punishment is insufficient given the severity and societal repercussions of the crime.
The trial court had found these individuals guilty of numerous charges, including criminal conspiracy, wrongful confinement, assault with the intent to outrage modesty, kidnapping, and gang rape, as defined under the Indian Penal Code.
They received 20 years of rigorous imprisonment, the minimum sentence mandated for gang rape, alongside concurrent sentences for related offenses.
The court also mandated that ₹5 lakh from the fine be allocated to the survivor as compensation.
In the meantime, some of the convicted individuals have approached the High Court to contest their convictions and seek the suspension of their sentences.
