Will the Lokpal Decide on CBI Sanction Against Mahua Moitra in Two Months?
Synopsis
Key Takeaways
New Delhi, Jan 23 (NationPress) The Delhi High Court has granted the Lokpal of India a final extension of two months to make a decision regarding the sanction for the Central Bureau of Investigation (CBI) to file a charge sheet against Trinamool Congress (TMC) MP Mahua Moitra related to the alleged cash-for-query scandal.
A bench comprising Justices Anil Kshetarpal and Harish Vaidyanathan Shankar approved the Lokpal's request for additional time, emphasizing that no further extensions will be permitted for the anti-corruption body.
“The extension period is set to two months, with the clear instruction that no further requests for time extensions will be considered,” stated the Justice Kshetarpal-led bench.
The court underscored that any further delays in addressing the matter would be unacceptable and insisted that the Lokpal adhere strictly to the given timeline.
This ruling was prompted by a plea from the Lokpal after it failed to reach a decision within the previously set time limits established by the Delhi High Court.
On December 19, 2025, the court had annulled the Lokpal’s authorization for the CBI to file charges against Moitra, finding that the anti-corruption agency had misinterpreted the provisions of the Lokpal and Lokayuktas Act, 2013.
In response to Moitra’s appeal against the sanction order, the Delhi High Court accepted her argument that the Lokpal did not adequately consider the necessary statutory requirements, which include reviewing the comments and information submitted by the public servant before issuing a sanction. The court directed the Lokpal to reassess the matter within a month.
However, due to the Lokpal's failure to make a decision within the stipulated timeframe, the agency sought an extension from the Delhi High Court.
The allegations stem from claims made by Bharatiya Janata Party (BJP) MP Nishikant Dubey, who accused Moitra of receiving cash and luxury gifts from Dubai-based businessman Darshan Hiranandani in return for raising questions in Parliament.
