New Delhi, April 3 (NationPress) The Election Commission of India (ECI) has issued new guidelines to states and union territories preparing for Assembly elections and bypolls occurring soon, aimed at ensuring maximum voter participation in the electoral process.
In an extensive announcement, the polling authority detailed the provisions for granting a paid holiday to voters on the election day in their respective regions. The ECI has also warned employers against any violations, indicating that circumvention of these guidelines may lead to penalties.
Citing the Representation of the People Act, 1951, the ECI stated, “Every individual engaged in any business, trade, industrial venture, or other establishments who is eligible to vote in an election for the House of the People or the Legislative Assembly of a State/UTs or a bye-election to a PC/AC shall be entitled to a paid holiday on the polling day.”

Importantly, Assam, Kerala, Tamil Nadu, West Bengal, and Puducherry are scheduled to elect new Legislative Assemblies, while by-elections are set to take place in eight Assembly constituencies across Goa, Gujarat, Karnataka, Maharashtra, Nagaland, and Tripura.
Assam, Kerala, and Puducherry will vote on April 9, Tamil Nadu on April 23, with West Bengal conducting elections in two phases on April 23 and 29.
The respective state governments have already declared public holidays on polling day to ensure smooth electoral proceedings. All government offices, institutions, and colleges will remain closed in these states.
Reiterating the provisions regarding paid holidays, the ECI stated, “Any employer who violates these provisions will face fines. All daily wage and casual workers are equally entitled to a paid holiday on the polling day.”
Electors working outside their constituencies will also be eligible for a paid holiday.
“Electors (including casual and daily wage workers) employed in industrial or commercial establishments outside their constituency but registered as voters in a constituency holding elections shall also benefit from a paid holiday on the polling day to allow them to cast their vote,” the ECI specified in its notification.
