PIL in Patna HC demands independent probe into Bhojpur encounter death
Synopsis
Key Takeaways
A Public Interest Litigation (PIL) has been filed in the Patna High Court seeking an independent investigation into the death of Bharat Bhushan Tiwari in an alleged police encounter in Bihar's Bhojpur district, intensifying the controversy surrounding the incident. The petition, filed by Advocate Mukesh Kumar, demands an impartial probe and legal action against police personnel found responsible.
What the PIL Demands
The petitioner has sought an urgent hearing before a bench headed by Acting Chief Justice Meenakshi Madan Rai. The PIL calls for a full independent investigation into the circumstances of Bharat Bhushan Tiwari's death, security protection for the victim's family, and accountability for any wrongdoing established by the probe.
Notably, the petition raises a pointed question: a video allegedly surfaced on social media before the encounter showing Tiwari carrying a pistol. The petitioner has questioned why police did not arrest him or seize the weapon at that time if he was visibly armed — a gap in the official account that has not been publicly addressed.
Two Conflicting Versions
The controversy centres on sharply divergent accounts of what happened. Bhojpur police maintain that Tiwari fired between 10 and 12 rounds at the police team during the operation, and that officers returned fire in self-defence, resulting in his injuries. He was initially taken to Ara Sadar Hospital and later referred to Patna Medical College and Hospital (PMCH), where he died during treatment.
The family, however, has consistently alleged the encounter was staged. According to relatives, Tiwari had surrendered and was unarmed at the time of the shooting. They have also objected to police registering an FIR against the deceased's father, brother, and several villagers following protests that erupted after his death.
Government Response and Administrative Action
The Bihar government has announced a judicial inquiry into the incident, to be conducted by a retired High Court judge. However, the petitioner has pointed out that a formal notification for the inquiry has yet to be issued — raising questions about the pace and intent of official action.
As an initial administrative measure, four police personnel have been suspended in connection with the case. Reports indicate that the Station House Officer of Shahpur police station has also been suspended.
Protests Spread Across Bihar
The incident, which triggered protests in multiple districts, has drawn sustained public anger. In Gopalganj, hundreds of citizens, social activists, and members of various organisations participated in a candle march from Post Office Chowk to Thana Chowk. Protesters alleged that the encounter violated established legal procedures and human rights protections.
In Kaimur district, political activists and social organisations held an outrage march from Bhabua Municipal Ground to Ekta Chowk. Binod Tiwari of the Parashuram Sena alleged the encounter was staged and demanded the dismissal of the officials involved.
Following Tiwari's death, villagers staged protests on 19 June, blocking the national highway by placing his body on the road.
What Happens Next
With the matter now before the Patna High Court, human rights bodies, and a proposed judicial inquiry, multiple parallel processes are expected to examine whether procedures were followed or violations occurred. The outcome of the High Court's decision on the PIL's urgency will be a key indicator of how swiftly accountability mechanisms are set in motion.
