New Delhi, Apr 22 (NationPress) A public interest litigation has been submitted to the Supreme Court addressing the contemptuous actions of BJP Lok Sabha member Nishikant Dubey, who has been accused of scandalizing the highest court and the Chief Justice of India (CJI).

According to the petition, Dubey, a Member of Parliament representing Godda in Jharkhand, issued a highly provocative, hateful, and scandalous statement against CJI Sanjiv Khanna and the nation's foremost judicial institution.

In an interview, Dubey claimed that “Chief Justice of India Sanjeev Khanna is responsible for all the civil wars happening in India” and that “only the Supreme Court is to blame for provoking religious conflict in this country”.

The plea asserts that the entire content of the interview is laden with derogatory language aimed at the judiciary and the Supreme Court. Such behavior constitutes an offense under the BNS and also violates Section 15 of the Contempt of Courts Act, 1971, according to advocate Vishal Tiwari, who filed the petition.

The PIL emphasizes the necessity of safeguarding the dignity of the Supreme Court and its judges, urging the court to exercise its authority under Article 129 of the Constitution of India, which grants it the power to punish for contempt.

Earlier, the Supreme Court consented to schedule a hearing next week regarding a plea that seeks to eliminate derogatory social media posts aimed at the judiciary following Dubey's offensive comments.

The day before, the apex court permitted advocate Tiwari to submit a new petition after he requested to amend his plea in light of the serious remarks made against the Chief Justice of India.

“You can file a new petition,” stated a bench comprising Justices Surya Kant and N.K. Singh, stressing that the claims made in the petition should not violate the dignity and decorum of the institution. The previous PIL requested the establishment of a five-member judicial inquiry commission, led by a retired apex court judge, to investigate the violent protests that erupted against the Waqf (Amendment) Act, 2025, in Murshidabad, West Bengal.
