Supreme Court Provides Relief to Jharkhand CM Hemant Soren in ED Case

New Delhi, Feb 25 (NationPress) The Supreme Court has provided interim relief to Hemant Soren, the Chief Minister of Jharkhand, concerning a case about his alleged failure to comply with the Enforcement Directorate's (ED) summons.
A division bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi has suspended the ongoing proceedings in the MP-MLA Special Court in Ranchi and has issued a notice to the ED, requesting its response regarding the issue.
This case originated from a complaint filed by the ED on February 19, 2024, at the Chief Judicial Magistrate (CJM) court in Ranchi, which claimed that Soren did not comply with several summonses related to a money laundering investigation associated with a purported land scam in the Bargain area of Ranchi.
The ED stated that Soren was initially summoned on August 14, 2023, with additional summonses following on August 19, September 1, September 17, September 26, December 11, and December 29 of 2023, as well as on January 13, January 22, and January 27 of 2024, bringing the total to ten summonses.
The agency asserted that Soren attended only two of the appointments, which they argue constitutes a breach of Section 63 of the Prevention of Money Laundering Act (PMLA) and Section 174 of the Indian Penal Code.
The CJM court acknowledged the complaint on March 4, 2024, after which the case was passed to the MP-MLA Special Court.
Soren appealed the decision in the Jharkhand High Court to have the proceedings dismissed. However, the High Court chose not to intervene and mandated that the trial continue.
Following this, Soren turned to the Supreme Court to contest the High Court’s ruling. During the recent proceedings, his attorney, Pragya Singh Baghel, contended that the Chief Minister had submitted written replies for any summonses he missed and had attended subsequent meetings with the ED. The defense claimed the complaint had malicious intentions.
The Supreme Court will hear the matter further after the ED submits its response.
