Ranchi, Jan 16 (NationPress) The Jharkhand High Court has issued an immediate stay on the Ranchi Police investigation concerning the alleged assault on money-laundering suspect Santosh Kumar at the Enforcement Directorate (ED) office in Ranchi.

This interim ruling was made by a Bench led by Justice Sanjay Kumar Dwivedi while addressing a criminal writ petition submitted by the ED, which contested the FIR and subsequent police actions against its personnel.

During proceedings, the High Court remarked that the operations of a federal investigative body must not be hindered under the pretense of a police investigation.

The court highlighted that the current police actions against ED officials could negatively impact the federal agency's functions.

Considering these factors, the court imposed a temporary suspension on the Ranchi Police’s investigation.

The High Court instructed the Jharkhand government to submit its response within seven days, while the complainant, Santosh Kumar, has been ordered to provide his reply within ten days.

A follow-up hearing is set for February 9.

Furthermore, the court mandated that the security of the ED office in Ranchi be assigned to the CISF, BSF, or any other central paramilitary force. The Senior Superintendent of Police (SSP), Ranchi, has been tasked with ensuring sufficient security at the ED office.

This decision has alleviated concerns for the two ED officials who faced an FIR registered at the Ranchi Airport Police Station on January 12.

Additionally, the court instructed the ED to maintain all CCTV footage related to the incident at its office.

Previously, on Thursday, the ED had approached the High Court, alleging “raid-like” conduct by the Jharkhand Police at its Ranchi office, seeking to dismiss the FIR, halt the state police investigation, and transfer the probe to the CBI.

The conflict emerged after Santosh Kumar, an employee of the Drinking Water and Sanitation Department (PHED) and a suspect in a money-laundering case, filed an FIR claiming he was assaulted, verbally abused, and mistreated during interrogation at the ED office on January 12. The ED has refuted these allegations.

In the wake of the complaint, a Ranchi Police team arrived at the ED office on Thursday, leading to a tense confrontation between the federal agency and the state police.

Point of View

The recent court ruling reflects the delicate balance between state law enforcement and federal investigative bodies. It emphasizes the need for cooperation and respect for jurisdictional boundaries, ensuring that justice is served without interference.
