Ranchi, March 11 (NationPress) In a pivotal ruling, the Jharkhand High Court addressed the escalating tensions between the Enforcement Directorate (ED) and the Jharkhand Police. On Wednesday, the court mandated that the Central Bureau of Investigation (CBI) undertake an inquiry into the FIR filed against ED officials and the associated circumstances.
Justice Sanjay Kumar Dwivedi issued the judgment after extensive deliberations from all involved parties, instructing that the case be referred to the CBI for thorough investigation.
This decision is viewed as a substantial blow to the state government and the Ranchi police. The ED had previously described the FIR against its personnel at the Ranchi Airport police station as unfounded and sought its annulment, concurrently requesting a CBI inquiry into the entire situation.
The dispute originated when Santosh Kumar, a staff member of the Drinking Water and Sanitation Department and a suspect in a money laundering investigation, lodged a complaint against ED officials. He claimed he was subjected to physical assault, verbal abuse, and psychological torment during his interrogation at the ED office in Ranchi on January 12.
In response to the complaint, the Ranchi police registered an FIR against ED officials and executed a raid on the ED office. This action escalated tensions between the state police and the central agency.
Following these developments, the ED approached the High Court with a writ petition, asserting that the police's actions were malicious and aimed at hindering the agency's investigation.
During the proceedings on January 16, the High Court imposed a stay on the Ranchi police's investigation and made strong remarks emphasizing that the operations of a central investigative body should remain unimpeded.
The court also mandated that the security at the ED office be provided by central paramilitary forces such as the CISF, BSF, or other relevant agencies, and required the preservation of CCTV footage pertaining to the incident.
Representing the ED during the hearing were Assistant Solicitor General of India S.V. Raju, alongside advocates A.K. Das and Saurabh Kumar. Senior Supreme Court advocate S. Nagamuthu, Advocate General Rajiv Ranjan, and advocate Dipankar represented the state government. Advocate Sumit Gadodia appeared for the complainant.
