Should Priya Kapur and Mandhira Kapur Smith Stop Public Statements in Sunjay Kapur Case?
Synopsis
Key Takeaways
New Delhi, Feb 17 (NationPress) The Delhi High Court has instructed Priya Kapur, the widow of the late industrialist Sunjay Kapur, and his sister Mandhira Kapur Smith to cease making any public comments against one another. A ruling from a single-judge Bench led by Justice Mini Pushkarna came during the proceedings of a civil defamation case initiated by Priya Kapur against Mandhira Kapur Smith and podcast presenter Pooja Chaudhri.
Justice Pushkarna remarked, “We anticipate you to refrain from making any public remarks against each other. Uphold your dignity, as this is the court’s expectation.”
The Delhi High Court, while addressing the interim relief request filed by Priya Kapur, mandated that Mandhira Kapur respond within five weeks.
“Issue notice. Schedule for five weeks later. Meanwhile, both parties are instructed to practice restraint in making remarks about each other, either directly or indirectly,” the order specified.
The case is set for further discussion on May 14.
Priya Kapur seeks Rs 20 crore in damages along with permanent and mandatory injunctions to prevent the defendants from disseminating any purportedly defamatory statements against her.
The lawsuit alleges that after her husband's death on June 12, 2025, in the UK from sudden cardiac arrest, Mandhira Kapur initiated a “systematic and organized campaign” to defame and socially undermine her via interviews, podcasts, social media, and public statements.
The complaint claims that the disputed statements falsely attribute “dishonesty, moral impropriety, professional incompetence, asset concealment, and illegitimate corporate control” to the plaintiff and are described as “per se defamatory, reckless, and malicious.”
Moreover, it asserts that the content was intentionally amplified through the podcast “InControversial with Pooja Chaudhri” and extensively shared across digital platforms like YouTube, Instagram, and X, resulting in “serious and ongoing harm” to her reputation, dignity, and mental well-being.
The complaint emphasizes that the disputed content is “per se defamatory, reckless, and malicious” and is not shielded by the fair comment or opinion defense.
This civil suit is part of a larger legal conflict between the parties. Priya Kapur has also commenced criminal defamation actions in the Patiala House Courts and filed a police complaint alleging threats and intimidation.
