Why Did Calcutta HC Reject the Anticipatory Bail of Rajganj BDO in Gold Trader's Murder Case?
Synopsis
Key Takeaways
Kolkata, Dec 22 (NationPress) The Calcutta High Court ruled on Monday to deny the anticipatory bail request from Rajganj Block Development Officer (BDO) Prashant Barman, who is implicated in the murder of gold trader Swapan Kamilya in the Dattabad locality of Salt Lake.
Justice Tirthankar Ghosh instructed Barman to present himself at the Bidhannagar Court within a span of 72 hours.
The High Court expressed discontent with the Barasat Court, which had granted anticipatory bail the previous month, noting that the lower judiciary overlooked critical evidence and essential aspects in a murder investigation.
This decision followed an appeal from the Bidhannagar Police against the earlier bail ruling.
Kamilya was reportedly abducted on October 28 from a gold shop in Dattabad, using a vehicle adorned with a blue beacon, which is allegedly associated with governmental operations.
His remains were later discovered in Jatragachi, New Town.
Authorities registered a case involving kidnapping and homicide, with the victim’s family alleging Barman orchestrated the crime.
Investigative efforts led to the arrest of several of the BDO's associates, along with the confiscation of the government vehicle purportedly utilized for body disposal.
Despite denying the charges, Barman had successfully obtained anticipatory bail from the Barasat Court last month, which was subsequently upheld by the Bidhannagar Sub-divisional Court.
The High Court’s recent ruling nullifies that earlier decision, intensifying the pressure on the accused to adhere to the surrender directive.
