Court Grants Bail to Atul Subhash's Estranged Wife and Family in Suicide Case

Bengaluru, Jan 4 (NationPress) A court in Bengaluru has approved bail for the estranged wife and in-laws of automobile executive Atul Subhash, who tragically committed suicide last month, citing a troubled marriage and accusing his spouse of harassment.
The family of Atul Subhash has indicated their intent to appeal the bail decision in the High Court of Karnataka once they receive the order sheet.
The bail has been granted to Atul's wife Nikita Singhania, her mother Nisha Singhania, and brother-in-law Anurag Singhania.
They are expected to be released from the Bengaluru Central Prison within a day or two upon completing the necessary formalities.
Vinay Singh, the attorney representing Atul Subhash's family, remarked, "We need the complete order copy to provide further comments. The court has informed us that the bail petition has been approved, which means that the accused will be released on bail. We will analyze the order sheet upon receiving it, and if there are grounds for appeal regarding the bail conditions, we will approach the higher court."
“The primary arguments presented were based on technical grounds, including the legitimacy of the arrest and the fundamental rights of the petitioner. This was merely a bail application, and there was no discussion regarding the custody of the child involved,” he added.
Attorney Ponnanna, also representing Atul Subhash's family, stated, "The argument presented was straightforward. The opposing side claimed no instigation or provocation from their side. Our position was that there exists a detailed 24-page suicide note and a video exceeding an hour that has surfaced. We contended that this video should be prioritized, and a thorough investigation is warranted."
Atul Subhash took his own life, alleging that his wife demanded Rs 3 crore for divorce settlement.
The police filed an FIR against the accused under Sections 108 and 3 (5) of the Bharatiya Nyay Sanhita (BNS) on December 9.
Bikas Kumar (Atul's brother) lodged a complaint with the Marathahalli police in Bengaluru, alleging abetment to suicide.
Bikas claimed in his complaint that false accusations were leveled against his brother by the accused, who demanded Rs 3 crore to settle the case. He also alleged that his brother faced taunts in court during proceedings, being told he had to either pay Rs 3 crore or take his own life.
Nikita's family contended that the deceased Subhash demanded a substantial dowry from them, which they claim contributed to her father's demise.
Pavan Kumar Modi, Atul's father, expressed concern for the safety of his son's child, stating, "If the court grants bail to Atul's wife, she could pose a threat to the child’s safety. If she was capable of driving my son to suicide, she could similarly endanger the kid's life."
"My grandson was a financial resource for her. She received money under the pretense of caring for him. She approached the High Court demanding amounts ranging from Rs 20,000 to Rs 40,000, and later escalated her demands to Rs 80,000. Even after that, she continued to ask for more funds. Therefore, we have approached the Supreme Court for custody of the child, asserting that he is safer with us," he remarked.
