New Delhi, Jan 19 (NationPress) The Delhi High Court is set to review on Monday the petitions submitted by Rashtriya Janata Dal (RJD) leader Lalu Prasad Yadav along with his family members, contesting a trial court's ruling that mandated the framing of criminal charges against them in the purported IRCTC hotel scam case.
According to the cause list available on the official Delhi High Court website, these matters are scheduled for consideration before Justice Swarna Kanta Sharma on January 19.
The criminal revision petitions have been lodged by Lalu Prasad Yadav, his wife Rabri Devi, and their son Tejashwi Yadav, challenging the trial court's directive to frame charges pertaining to corruption, criminal conspiracy, and cheating in the IRCTC hotel scam case.
Previously, the Delhi High Court had notified the Central Bureau of Investigation (CBI) regarding the criminal revision petitions, including an application from Rabri Devi and Tejashwi Yadav seeking a halt to the trial court proceedings.
While issuing this notice, Justice Sharma indicated that the pleas should be addressed concurrently with the criminal petition filed by Lalu Prasad Yadav.
In her petition, Rabri Devi argued that the trial court had incorrectly framed charges against her based solely on assumptions, without thoroughly evaluating the evidence.
Tejashwi Yadav has also contested the legality of the trial court's decision, asserting that the prosecution failed to establish a prima facie case justifying the charges.
In an order dated October 13, 2025, Special Judge (PC Act) Vishal Gogne of the Rouse Avenue Courts permitted the trial of Lalu Prasad Yadav, Rabri Devi, Tejashwi Yadav, and other defendants under Sections 420 (cheating) and 120B (criminal conspiracy) of the Indian Penal Code (IPC), as well as under the Prevention of Corruption Act, after they pleaded not guilty to the charges.
The special court had reserved its ruling on May 29 after extensive discussions regarding the framing of charges against Lalu Prasad Yadav, his family, Prem Gupta, Sarla Gupta, and railway officials Rakesh Saksena and P.K. Goyal.
The alleged scam is said to have occurred between 2004 and 2009, during which Lalu Prasad Yadav served as the Railway Minister.
During his tenure, two IRCTC hotels were reportedly leased without adhering to established regulations. One of these hotels was granted to Sarla Gupta, the spouse of Prem Gupta, a close associate of the RJD leader and a Rajya Sabha MP at the time.
According to the prosecution, the RJD leader acquired three acres of valuable land through a benami entity.
Lalu Prasad Yadav has asserted that he committed no irregularities, maintaining that the tenders were awarded fairly and transparently, and has requested his discharge from the case.
