Bengaluru, Feb 17 (NationPress) On Tuesday, the Karnataka High Court annulled a criminal defamation lawsuit initiated by the Bharatiya Janata Party (BJP) against Congress leader Rahul Gandhi, who was accused of disseminating propaganda against the party.
The case revolves around a "corruption rate card" advertisement aimed at the former BJP administration during the Assembly elections. Rahul Gandhi had sought to dismiss the charges filed against him. The court noted that permitting the case to proceed would constitute an abuse of legal process.
A bench led by Justice Sunil Dutt Yadav issued the ruling, stating that the proceedings concerning petitioner Rahul Gandhi are nullified.
The complaint originated from BJP leader Keshav Prasad, who alleged that Chief Minister Siddaramaiah, Deputy Chief Minister D.K. Shivakumar, and Rahul Gandhi published misleading advertisements against the then BJP-led government under Basavaraj Bommai.
The allegations claimed that the accused released extensive advertisements in the media as part of a campaign accusing the previous BJP government of demanding a 40 per cent commission. Rahul Gandhi shared this on his social media platform X.
The advertisement, published on May 5, 2023, in all major newspapers, made absurd and unfounded claims against the BJP, according to the complaint.
In contesting the proceedings, it was argued that there was no prima facie evidence to substantiate the charges against Rahul Gandhi, and the complainant failed to present any documentation proving that Rahul Gandhi circulated the advertisement on his social media, apart from a bare assertion in the complaint that he directed the advertisements to be issued.
Rahul Gandhi appeared in front of the Special MP/MLA court in Bengaluru related to this case. Chief Minister Siddaramaiah and Deputy Chief Minister Shivakumar also attended court and obtained bail.
Deputy Chief Minister Shivakumar labeled the case as “false,” stating, “This is a fabricated case initiated by the Bharatiya Janata Party against me, Rahul Gandhi, and Chief Minister Siddaramaiah.”
It is noteworthy that the Congress made the 40 per cent commission claim a significant campaign topic against the then-ruling BJP. Initially raised in speeches, the allegations later extended to social media campaigns and posters across the state.
