Is Actor Dileep’s Exoneration Really Over? Prosecution Plans to Challenge Acquittal
Synopsis
Key Takeaways
Kochi, Dec 16 (NationPress) The prosecution has taken formal steps to contest the trial court's ruling in the prominent 2017 actress assault case in Kerala, focusing on the acquittal of actor Dileep, who is the eighth accused, alongside other defendants. A comprehensive report detailing the legal basis for the appeal has been compiled by the Special Public Prosecutor and is set to be presented to the Director General of Prosecutions this week. Following this report, the government is in the process of drafting the appeal, considering the rationale provided by the trial court.
This development indicates the State's determination to dispute crucial findings of the trial court, which concluded that the prosecution did not prove a broader conspiracy linking Dileep to the offense. Furthermore, adding complexity to the matter, the investigating officer, Baiju Paulose, has alerted the Director General of Police regarding an anonymous letter claiming that verdict details were disclosed prior to its official announcement.
Previously, the president of the High Court Advocates' Association filed a complaint with the Chief Justice upon receiving the letter. However, this situation has caused internal disagreements within the association, leading to a lack of unified action.
The anonymous letter alleged that the judgment, once written, was shown to a close associate of Dileep and that the court would convict accused numbers one to six while acquitting the others.
Nonetheless, the trial court has refrained from commenting on these claims.
In its ruling, the court stated that the prosecution did not manage to substantiate its allegation that the crime was carried out at Dileep's instruction. The initial charge sheet had asserted that the accused kidnapped the actress, filmed inappropriate visuals, and sought to blackmail her for financial gain, with all six main accused working towards this common goal.
While the first charge sheet suggested further inquiry, the court noted that this was mainly to retrieve the mobile phone and memory card used to capture the visuals. It observed no indication in the initial report of a conspiracy that went beyond the first accused, Pulsar Suni, and his accomplices.
The court also questioned whether the investigation against Dileep was initiated solely based on a letter from Pulsar Suni sent from prison, a point that will likely be pivotal in the prosecution's appeal.
