Kolkata, June 26 (NationPress) The Calcutta High Court has instructed the parents of the junior female doctor from the state-run R.G. Kar Medical College & Hospital in Kolkata, who was tragically discovered raped and murdered on the hospital grounds in August of the previous year, to consult the trial court in the city regarding obtaining permission to examine the crime scene.
This week, the victim's parents presented their case to the High Court's single-judge bench presided by Justice Tirthankar Ghosh, making two requests: one for expedited hearings and another for the ability to survey the crime scene.
In response, the Central Bureau of Investigation (CBI), currently investigating the broader conspiracy behind the heinous crime, informed Justice Ghosh's bench that they had no objections to the victim's parents conducting a survey of the crime scene.
During the session at Justice Ghosh’s bench on Thursday afternoon, the judge advised the victim’s parents to seek permission for the survey from the same trial court in Kolkata that earlier this year sentenced the sole convict in this case, civic volunteer Sanjay Roy, to life imprisonment.
In giving this directive, Justice Ghosh established a deadline for the trial court to make a decision within 48 hours of the application for survey permission being submitted by the victim's parents. He also empowered the trial court to determine the maximum number of individuals allowed to be present during the survey of the crime scene.
At present, this gruesome case of rape and murder is being examined in three different courts. The initial case is at the trial court in Kolkata, where Roy was sentenced to life imprisonment.
The ongoing proceedings at the trial court involve the investigation into a larger conspiracy related to the alteration and tampering of evidence during the initial stages of the investigation by the Kolkata Police before the case was transferred to the CBI.
Two additional cases related to this matter are pending before the Calcutta High Court: one is the victim's parents' plea for a fresh investigation into the crime of rape and murder, and the other relates to the CBI’s appeal for a death sentence for the convict.
Additionally, a hearing is concurrently being held at the Supreme Court.
The CBI has submitted four status reports to the trial court detailing the progress of its investigation into the broader conspiracy behind the crime. However, the victim’s family’s legal representative has previously accused the agency of being disingenuous in their subsequent status reports.
Moreover, the CBI has faced criticism for what has been perceived as a lackadaisical approach to the investigation since its inception.
