Kolkata, July 16 (NationPress) The Calcutta High Court is set to review the acquittal plea submitted by civic volunteer Sanjay Roy, who is implicated in the R.G. Kar rape and murder case. The hearing will commence in September, presided over by the Division Bench of Justice Debangsu Basak and Justice Shabbar Rashidi.
The court has accepted the acquittal petition filed last week, and stated that it will be addressed in September, alongside a related petition where the Central Bureau of Investigation (CBI) is petitioning for the death penalty for Roy.
Earlier this year, a Kolkata trial court sentenced Sanjay Roy to life imprisonment, declaring him the sole perpetrator in the rape and murder of a junior doctor associated with R.G. Kar Medical College & Hospital in Kolkata, which occurred on the hospital grounds in August of the previous year.
Subsequently, the CBI contested the trial court's decision, seeking the death penalty for Roy.
Last week, Roy's attorney presented the acquittal request before the Division Bench, and the case was reviewed on Wednesday.
In court, Roy's attorney, senior advocate Kaushik Gupta, argued that the allegations against his client lacked sufficient evidence and witnesses, supporting the request for acquittal.
The Division Bench also noted that the victim's parents could participate in the proceedings regarding Roy's acquittal petition if they wished to do so.
The body of the junior doctor was discovered in a seminar hall on the hospital grounds on August 9 of last year.
Initially, the Kolkata Police conducted the investigation, leading to Roy's arrest. However, following a directive from the Calcutta High Court, the CBI subsequently took over the investigation.
Through an extensive investigation, the CBI identified him as the sole suspect in the rape and murder case.
During the investigation, the CBI also apprehended the former principal of R.G. Kar, Sandip Ghosh, and the former officer-in-charge of Tala Police Station, Abhijit Mondal, for allegedly tampering with evidence.
Nevertheless, both Ghosh and Mondal were granted 'default bail' by the trial court due to the CBI's failure to submit additional charge sheets against them.
After months of hearings, the trial court convicted Sanjay Roy of the rape and murder charges and sentenced him to life imprisonment in January this year.
