New Delhi, May 15 (NationPress) The Supreme Court delivered a stern rebuke to Madhya Pradesh Tribal Affairs Minister Vijay Shah on Thursday regarding his controversial statements about Army officer Colonel Sofiya Qureshi.

"What kind of remarks are you (Shah) making? An individual in a constitutional position should demonstrate a level of restraint. Each statement from a minister must be made responsibly," commented a bench led by Chief Justice of India (CJI) B.R. Gavai.

This observation arose when Shah's attorney requested an urgent hearing for his special leave petition (SLP) against the Madhya Pradesh High Court's order mandating an FIR against him for his inappropriate comments.

Senior advocate Vibha Dutta Makhija, representing Vijay Shah, argued that the media exaggerated the minister's remarks, and he has already expressed regret.

Makhija sought an interim order to prevent any coercive measures against Vijay Shah related to the FIR filed under Sections 152, 196(1)(b), and 197 of the Bharatiya Nyaya Sanhita (BNS).

The Apex Court did not issue any interim order but agreed to review the case on Friday and advised the senior counsel to inform the Madhya Pradesh High Court regarding the SLP's listing.

Earlier, the Madhya Pradesh High Court ordered the Director General of Police (DGP) to file a criminal case against Shah within four hours, cautioning the DGP about potential contempt actions for any delays.

A bench comprising Justices Atul Sreedharan and Anuradha Shukla of the MP High Court stated that, prima facie, Shah appeared to have committed an offense by inciting enmity among various castes, religions, and languages.

The Justice Sreedharan-led Bench deemed Shah's reference to Colonel Sofiya Qureshi as a "sister of terrorists" as an offense that could hurt the sentiments of the Muslim community.

In discussing Operation Sindoor, Vijay Shah asserted that Prime Minister Narendra Modi sent a "sister from the same community" as those in Pakistan to retaliate for the April 22 terror attack in Kashmir's Pahalgam.

"PM Modi is working for society. Those who caused our daughters' grief in Pahalgam, we dispatched a sister of their own to impart a lesson," Shah remarked.

His inappropriate comments regarding Colonel Sofiya Qureshi, who briefed the media during Operation Sindoor against Pakistan, ignited widespread outrage across the nation.

Subsequently, the Minister expressed an apology from the "depths of his heart" and affirmed his respect for the Armed Forces, referring to Colonel Sofiya as "sister".

"I, Vijay Shah, am deeply ashamed and saddened by my recent statement, which has offended the sentiments of all communities. I sincerely apologize. Our nation's sister Sofia Qureshi ji has performed her national duty above caste and societal lines," he stated in a video posted on the social media platform X.

In his petition to the Top Court, Shah has requested the dismissal of the FIR and the suo motu proceedings initiated by the MP High Court.
