New Delhi, Oct 29 (NationPress) The Supreme Court is set to examine the petition that contests the detention of Sonam Wangchuk, a climate activist and innovator from Ladakh, under the National Security Act (NSA) on Wednesday.
This case, brought forward by Wangchuk’s wife, Gitanjali J. Angmo, challenges the legality of his detention and the procedural steps taken by the authorities.
Earlier this month, a panel of Justices Aravind Kumar and N.V. Anjaria granted Angmo permission to amend her writ petition after her attorney, senior advocate Kapil Sibal, requested to incorporate new information provided by the government.
Sibal informed the court that the Central government had presented the grounds for Wangchuk’s detention, prompting the need for changes to the initial plea. “I will revise the petition to ensure it can proceed here,” he stated. Consequently, the court scheduled the matter for further discussion on Wednesday.
The original petition to the Supreme Court claimed that the authorities did not provide the grounds for detention as mandated by Section 8 of the NSA, which stipulates that detainees must be informed of their detention reasons in a timely manner. However, the Leh administration, in an affidavit submitted by District Magistrate Romil Singh Donk, asserted that the grounds were communicated to Wangchuk within the required timeframe.
Meanwhile, the Advisory Board established under the NSA recently evaluated Wangchuk’s detention. The three-member panel, led by former judge M.K. Hujura (Chairman), District Judge Manoj Parihar, and social activist Spal Jayesh Angmo, conducted a three-hour closed session at the Jodhpur Central Jail in Rajasthan. Both Wangchuk and his wife were present during the proceedings.
The hearing reportedly concentrated on the administration's rationale for invoking the NSA and on Wangchuk’s arguments against it.
Wangchuk, known for his sustainable innovations and environmental advocacy in Ladakh, was detained under the NSA, a decision that incited nationwide protests and drew condemnation from civil rights organizations, which labeled his detention as arbitrary and unwarranted.
