Kochi, Feb 19 (NationPress) In a momentous ruling for the Kerala Cricket Association (KCA), the Kerala High Court has affirmed that the cricket facility located at Badiadka in Kasaragod serves a vital public function, urging the State government to address the matter with utmost seriousness. The court has also decided to extend the interim stay on the demolition of the ground, which was previously ordered due to claims of encroachment, until a conclusive resolution is reached.

The court instructed the Principal Secretaries of both the Local Self-Government and Revenue Departments to finalize their decision within a period of four months.

It was emphasized that the interim order prohibiting coercive measures would remain effective until the government has completed its review.

This order was issued while considering a petition from the KCA that contested actions initiated following a report from the District Collector alleging encroachment on 1.09 acres of government property.

The court acknowledged the association's position that the findings were not supported by a scientifically conducted survey.

The High Court indicated that the KCA could formally request the government to perform a scientific assessment of the disputed land.

Upon such a request, the relevant authorities are required to conduct a thorough survey, and the government must carefully evaluate the resulting report and map prior to making a final decision.

In response to claims that 40 cents of puramboke (government land) had been encroached upon during the construction, the KCA clarified to the court that the land had been reclaimed at the time of acquisition and that no canal was visible then.

Additionally, it referenced the Collector's report affirming that the diversion of the canal had not negatively impacted water flow.

KCA Secretary Vinod S. Kumar shared with IANS that the ground is operational, featuring pitches and practice areas.

“Indeed, this ruling has provided significant relief for the KCA. We are optimistic that matters will be resolved favorably,” Kumar stated.

Point of View

It is my responsibility to highlight the importance of this ruling for the KCA and the local community. The High Court's decision reflects a commitment to ensuring that public facilities are preserved and that due process is followed in matters of land use. We stand with the community in advocating for a fair and thorough investigation.
