New Delhi, Sep 8 (NationPress) The BJP issued a warning on Monday regarding potential misinterpretations of the Supreme Court’s decision concerning Aadhaar and the Special Intensive Revision of electoral rolls in Bihar. They emphasized that this ruling does not equate to automatic voter roll inclusion simply by presenting an Aadhaar card.
Amit Malviya, who oversees the BJP's National Information and Technology Department, stated that the Supreme Court has granted the Election Commission of India (ECI) the authority to verify the authenticity and validity of the Aadhaar card at any point during the enumeration process.
“The Election Commission of India is the ultimate authority in this matter. Aadhaar serves solely as a proof of identity as outlined in Section 23(4) of the Representation of People Act, 1950, and the ECI has consistently recognized it as such,” Malviya explained.
On Monday, the Supreme Court directed the ECI to accept the Aadhaar card as the 12th document in the designated list for the voter verification initiative in Bihar, while also advocating for its acceptance as a valid identity proof.
Breaking down the Supreme Court’s remarks regarding the Special Intensive Revision (SIR), ECI’s attorney Rakesh Dwidevi noted that various petitioners had presented their cases regarding Aadhaar’s inclusion in the verification process. However, the Supreme Court clarified that while Aadhaar cards will be acknowledged for the SIR exercise, they cannot be deemed as proof of citizenship.

He further criticized the Election Commission for creating barriers that hinder the registration of eligible voters, pointing out its refusal to recognize Booth Level Agents (BLA) appointed by political parties, its reluctance to accept Aadhaar, and the issuance of notices to officials mandating acceptance only of documents approved by the Commission itself.
