Can OBC Certificates Issued After 2010 Be Used in Bengal's SIR?
Synopsis
Key Takeaways
Kolkata, Dec 24 (NationPress) A single-judge bench of the Calcutta High Court directed the Election Commission of India (ECI) on Wednesday to clarify whether Other Backward Class (OBC) certificates issued by the West Bengal government after 2010, which had been invalidated earlier by the court, can serve as supporting documents for the second phase of the three-stage Special Intensive Revision (SIR) in the state.
Last week, the West Bengal unit of the Bharatiya Janata Party (BJP) approached the single-judge bench, led by Justice Krishna Rao, requesting the court's intervention to restrict the use of OBC certificates issued post-2010 as supporting documents during the claims and objections hearing related to the draft voters' list, published on December 16.
This matter was addressed in the hearing on Wednesday, where Justice Rao stated that the ECI must decide whether these OBC certificates would be recognized as valid supporting documents.
Justice Rao also instructed the Commission to submit its observations on the matter within the next seven days.
The petition was filed last week, with the petitioner's counsel indicating that on May 22 of the previous year, the division bench of Justices Tapabrata Chakraborty and Rajasekhar Mantha had invalidated all OBC certificates issued by the West Bengal government after 2010.
In their ruling, the division bench decreed that these certificates should not be utilized for any purpose in the future.
Consequently, the petitioner's counsel argued that such invalidated OBC certificates should not be accepted as identity proof in the second phase of the three-stage SIR in the state.
The ECI had already published the draft voters' list in West Bengal on December 16.
The hearing process regarding claims and objections on the draft voters' list is set to commence next week, which will involve verifying identity documents.
The ECI specified 13 types of documents as acceptable forms of identity proof, including certificates for Scheduled Caste, Scheduled Tribe, and OBC.
The BJP unit in West Bengal has petitioned the Calcutta High Court to prevent the use of the invalidated OBC certificates as identity documents during the SIR exercise.
