Why is the BJP Challenging the Use of Cancelled OBC Certificates in Calcutta HC?
Synopsis
Key Takeaways
Kolkata, Dec 17 (NationPress) The West Bengal branch of the Bharatiya Janata Party (BJP) has approached a single-judge bench of the Calcutta High Court on Wednesday, requesting the court to intervene and prohibit the utilization of Other Backward Class (OBC) certificates issued by the West Bengal government post-2010. These certificates were previously annulled by the High Court and the BJP seeks to restrict their use as supporting documents during the second stage of the three-stage Special Intensive Revision (SIR) exercise in the state.
The request was acknowledged by Justice Krishna Rao of the single-judge bench, and the case is anticipated to be heard later this week.
The petitioner's attorney noted that a division bench of the Calcutta High Court, led by Justice Tapabrata Chakraborty and Justice Rajasekhar Mantha, annulled all OBC certificates issued after 2010 on May 22 of the previous year. The court ruled that these certificates should not be used for any future purposes.
Therefore, the petitioner’s attorney contended that the cancelled OBC certificates should not serve as documents of identity proof during the ongoing second stage of the SIR exercise.
The Election Commission of India (ECI) had released the draft voters’ list in West Bengal on Tuesday, with claims and objections scheduled to start next week, which will include the verification of identity documents.
The ECI has listed 13 acceptable documents for identity verification, including Scheduled Caste, Scheduled Tribe, and OBC certificates. In light of this, the BJP's West Bengal unit has approached the Calcutta High Court to prevent the use of the annulled OBC certificates as identity documents during the SIR exercise.
As of the time of this report, there has been no official response from either the Trinamool Congress or the state government concerning this matter.
