What Did the Delhi HC Direct Regarding Celina Jaitly's Brother's Legal Representation?
Synopsis
Key Takeaways
New Delhi, Feb 12 (NationPress) The Delhi High Court instructed the Centre on Thursday to notify Major Vikrant Jaitly (retd), who is currently incarcerated in a UAE prison, about the legal firm chosen by the Indian government to defend him in international legal matters.
A single-judge Bench led by Justice Purushaindra Kumar Kaurav was addressing a petition submitted by Jaitly’s sister, Bollywood star Celina Jaitly, alleging that her brother has been illegally abducted and detained in the United Arab Emirates. She requested legal representation and consular access for him.
During the session, the Ministry of External Affairs informed the high court that it has already sought consular access for Jaitly and has sent a letter authorizing an Emirati law firm to act on his behalf in the UAE. Furthermore, the Union government stated that necessary measures are being undertaken to guarantee suitable legal support.
Justice Kaurav, acknowledging these points, mandated the Centre to relay the details of the appointed law firm to Jaitly, enabling him to make an informed choice concerning his defense.
The Delhi High Court also noted a statement from Jaitly’s wife, indicating she had previously met him in a UAE prison and that he opposed the law firm recommended by his sister.
According to her, Jaitly has conveyed his desire for the Union Ministry of External Affairs to appoint and oversee his legal representation in the UAE.
Jaitly’s wife contended that Celina Jaitly approached the Delhi High Court without her approval and asserted that the authority to select a lawyer for her husband rests exclusively with her.
The court remarked that if Jaitly is not inclined to utilize the services of the firm suggested by Celina Jaitly, he may recommend an alternative. It also mandated that a copy of the petition filed by Celina Jaitly be provided to clarify whether Jaitly is willing to meet his sister.
Furthermore, the Delhi High Court previously expressed its intent to directly communicate with Jaitly via video conferencing to determine his preferences regarding his legal representation and the support he wishes to accept. The court emphasized that the main objective of the proceedings is to ensure that Jaitly’s legal rights are sufficiently safeguarded and that any representation aligns with his informed consent.
The matter is scheduled for further review on February 19.
Celina Jaitly had approached the Delhi High Court seeking assistance for her brother, asserting that the retired Indian Army officer, who has resided in the UAE since 2016, was “illegally abducted and detained” in September 2024 and sought directives for consular access and legal support.
