On Friday, the commission mandated that completion of all development works is essential before any plot can be incorporated into an e-auction.
The commission noted that this stipulation is crucial for ensuring convenience for allottees and maintaining transparency throughout the process.
A representative from the commission stated that participants in the e-auction process engage with confidence in the government.
“Under these circumstances, it is anticipated that the relevant department finalizes all basic infrastructure facilities and development initiatives promptly so that allottees can begin construction without facing any issues,” the spokesperson added.
During the hearing, the commission highlighted that, according to the terms of the allotment letter, interest charges due to delayed possession were not addressed in a timely manner.
Following the commission’s intervention, necessary measures were initiated.
The commission has instructed the Estate Officer to disburse the overdue interest amount to the allottee, adjust the possession date accordingly, and refund the extension fee collected, in compliance with established regulations.
Instructions have been issued for a compliance report to be submitted by February 5.
Upon reviewing the e-auction records, it was discovered that the plot was marked as “clear,” although the adjacent land was in the process of acquisition.
The commission stressed the necessity for heightened caution and coordination at the administrative level regarding such matters.
Details of the case have also been communicated to the state Chief Secretary, K.A.P. Sinha, to facilitate appropriate administrative corrective actions.
The commission has sanctioned compensation of up to Rs 5,000 to allottee Manoj Vashisht under the provisions of the Haryana Right to Service Act, 2014.
This amount is to be paid by HSVP within 15 days.
The department has also been authorized to recover the amount from the responsible officials as per regulations.
The Right to Service Commission expressed optimism that in the future, HSVP will conduct e-auctions only after all development works are completed and will adhere strictly to the commission's directives to prevent any inconvenience or distress for the buyers.
