Ranchi, Nov 28 (NationPress) The Jharkhand High Court expressed its strong dissatisfaction on Friday regarding the state government's inability to provide its response in a criminal writ petition advocating for a CBI investigation into the purported fake encounter of tribal leader Surya Hansda in Godda district.
During the hearing, a bench led by Justice Ambuj Nath allotted the government one last week to submit its reply, stating that the delay was intolerable given the gravity of the case. Advocate Kumar Harsh represented the petitioner.
The petition was submitted by Surya Hansda’s wife, Sushila Murmu, and his mother, Neelmuni Murmu, who claim that the police encounter was manipulated and that Surya was intentionally killed.
They have requested the court to mandate an investigation by an independent body, ideally the CBI, to guarantee a thorough and impartial examination.
According to the petition, the Godda police portrayed Surya’s demise as an encounter, whereas the family asserts that he was murdered in a premeditated operation. The petition argues that only a central agency can reveal the truth and deliver justice.
The Godda police reported that Surya Hansda, wanted in over 20 criminal cases, was shot dead near Dhamni Pahad under the jurisdiction of the Boarijore police station on August 11.
Authorities also claimed they retrieved weapons from the scene. According to Godda SP Mukesh Kumar, Surya was in custody and was being escorted by police for weapon recovery when his accomplices attacked.
Additionally, police alleged that Surya seized a firearm from an officer and attempted to escape, leading to police retaliating with gunfire that resulted in his death.
The National Commission for Scheduled Tribes (NCST) has also raised doubts regarding the encounter. Labeling the circumstances as “suspicious,” the Commission advocated for a CBI investigation after its team evaluated the site and recorded the statements of involved parties.
