New Delhi, April 20 (NationPress) A judge from the Delhi High Court on Monday stepped aside from presiding over the bail request submitted by former Aam Aadmi Party (AAP) MLA Naresh Balyan, who is seeking release in a case falling under the strict Maharashtra Control of Organised Crime Act (MCOCA).
Balyan's request, which contests the denial of his bail plea by a Delhi court, was set to be heard by Justice Swarana Kanta Sharma, who chose to recuse herself from the case.
This matter will now be redirected to another bench on April 23.
The ex-Uttam Nagar legislator was re-arrested by the Delhi Police Crime Branch in December 2024 under MCOCA, just moments after he received bail in an extortion case.
Following a bail grant from the Rouse Avenue Court regarding the extortion charges, he was taken into custody by police right within the court premises for his involvement in the organized crime case.
Balyan was initially detained on November 30, 2024, after audio recordings allegedly revealed him conversing with gangster Kapil Sangwan, also known as Nandu. These clips suggested plans to intimidate and extort funds from builders and others in the Delhi region.
As per police reports, Balyan is linked to a broader criminal network operating in Delhi and nearby areas, reportedly engaged in organized crimes like extortion and arms trafficking.
The charge sheet outlines this network as a systematic and well-organized group involved in illegal operations for profit. In a supplementary charge sheet filed by police, four individuals are named: Vijay alias Kalu, Sahil alias Poli, Balyan, and Jyoti Prakash alias Baba.
In their prior opposition to his bail application, the Delhi Police contended that the investigation is at a pivotal stage, and releasing him could obstruct the ongoing inquiry.
Conversely, Balyan and his supporters argue that the case is politically driven, asserting that the allegations are fabricated as part of a greater conspiracy.
The situation has also elicited political responses, with the BJP branding Balyan as an “extortionist” and alleging connections between AAP officials and criminal factions.
BJP representatives have claimed that Balyan's actions were conducted with the awareness of senior party members, a statement that AAP has categorically denied.
