Why Did Maha Assembly Speaker Reject Cong's Impeachment Demand Against SEC?
Synopsis
Key Takeaways
Nagpur, Dec 10 (NationPress) Maharashtra Legislative Assembly Speaker Rahul Narwekar on Wednesday dismissed the request from former Speaker and prominent Congress member Nana Patole to commence impeachment proceedings against the State Election Commissioner (SEC).
Patole has accused the SEC of creating chaos and irregularities during the recent local body elections in the state.
In his ruling, the Speaker stated that Patole’s petition was beyond the authority of the state Assembly and did not align with a recent Supreme Court ruling regarding the impeachment of a high court judge.
Patole charged the SEC with “strangling democracy in broad daylight” and argued that the confusion among voters stemmed from the SEC's negligence. He referenced Article 243 of the Constitution, claiming that if the irregularities are recognized, impeachment proceedings are necessary.
The Congress leader contended that since the Chief Minister acknowledged the extraordinary nature of the irregularities, impeachment under Article 243 should be pursued.
Previously, he publicly challenged the ruling Mahayuti government to bring forth the motion, asserting that any inaction would suggest they were “shielding the SEC.”
Recently, CM Fadnavis expressed dissatisfaction regarding the SEC's decision to delay local body elections in certain constituencies until December 20. “I cannot comprehend how they are interpreting rules to do this. I have consulted various experts, including a lawyer, and as far as I know, there is no provision to postpone elections a day before they are set to occur,” he remarked.
Shiv Sena (UBT) criticized the SEC for abruptly delaying elections scheduled for 24 nagar parishads and 154 wards in 76 nagar parishads and nagar panchayats, describing the move as a strategic political maneuver. “The democratic process in Maharashtra has been thrown into disarray. The SEC has demonstrated that its judgment is flawed, and it lacks the authority to postpone elections so suddenly,” the party stated.
In a particularly scathing editorial, the Thackeray faction in the party's publication 'Saamana' labeled the SEC a “joker” in the political arena, claiming that the government, particularly the BJP, has turned the Election Commission into its pawn. They asserted that it has led to a “planned mess and chaos,” with the only goal being to secure an advantage for the BJP.
